O America, My America

On the first page of the United States Constitution read the words “in order to form a more perfect union, establish justice, ensure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution of the United States of America”. American’s have long since regarded these choices as “by the people” but too seldom recognize the carefully crafted language and selfless commitments of the people in order to form “a more perfect union” and to “secure the blessings of liberty”.

Sitting in the eating area of the law school at Gonzaga University I had an experience you might find interesting. A fellow law student was complaining about a politician’s comments on the middle east and so I joined his conversation having read a couple books on the candidate which I felt might give me...wisdom and an ability to clear up the truths. His response was to bring up two other issues which were on the ballot in the November election--marijuana legalization and same-sex marriage recognition. I will support neither despite the alleged support of my fellow student.

My fellow student and fellow American tried by subversive means, which I do not believe he recognized to be subversive, to argue my stance away--my stance being that marriage is ordained of God and that marriage should be defined as being between only one man and one woman.

He tried to shake me with comparisons between same gender relationships and interracial relationships. This approach was surely not intended to “ensure domestic tranquility” in a country where slavery once existed. I have heard African Americans claim that such a comparison is, to them, offensive (e.g. Harvard Law alumni E. W. Jackson) as no homosexual has ever been enslaved in this country (to my knowledge). My qualm with this perspective is that in the one instance no marriage--man and woman was previously permitted whereas in the other a non-marriage of a man and a man should not be permitted and never before has been "by the people".

I was blessed after being born into a family made up of a man and a woman married lawfully who with responsibility loved and cared for each other and their children. Who would deny that this means that the “blessings of liberty” were secured for myself? My mother stayed home and taught me to read and write while my father went to work as an accountant. In the summers we took vacations. My parents paid taxes, voted regularly, bolstered their friends, and donated to church funds and charities the best they knew how in addition to caring for their children and supplying us with a home with a swimming pool.

My law school friend and I briefly discussed these blessings of liberty. I can point out now that children would be adversely affected if the laws regarding guardianship should become confused and dishonest. In the case of two homosexual women who enter a relationship there may already be children involved from a previous heterosexual relationship and then legal rights to the child as a guardian could potentially be invested in the two but what would happen if the “natural” mother became incapacitated or died? I read a real story of such a case in California. The “natural” father of the child wished to regain custody of the child and was facing a wall. This scenario would be essentially hopeless if marital status had been given to the homosexual partners. And, how would you like to be the judge who refuses to choose to allow such a daughter and father reunite? How would you feel about it?

When the argument is made to me that “it’s just two people who love each other trying to get married” it seems repelling and I am offended. I am married to my spouse, we are yet childless, and she and I try each day to love and respect one another. I am repelled by the call for my love to be compared to some relationship which may never directly naturally produce children (even given various forms of hormonal and scientific pathways to aiding the creation of children with help from family medicine).  Even the Supreme Court of the United States has recognized the sanctity of the family unit-- in the family is where values--morals and culture are traditionally best taught.  These values include religion. I do not advocate for the the establishment of a single religion contrary to our Constitution.  Additionally, it can be offensive to me to hear this comparison when I have read in the Bible Almighty God state that homosexual relationships are abominable in His eyes (Romans 1). At this point, hasn’t my faith been silenced and my belief been offended?  Hasn’t the most sacred part of my life been compared to something difficult to understand as a lost lamb?

Prior to the first judicial panel determining to allow same-sex marriage in Massachusetts on twenty six out of twenty seven occasions Americans had voted in their respective spheres of influence to define marriage as between one man and one woman. In fact, since 1998, thirty-two states have held votes on state constitutional amendments regarding same-sex marriage, and all thirty-two states have opposed it. Think briefly of the arrogance of that court.  How could a court begin to unravel charitable statuses for churches sustained by American people which protect the sanctity of marriage--this is a viable concern which I won't discuss briskly at this time.  How could a court not see the discouragement that could add to problems with civil marriages, declining families, and perhaps birth rates.

My discreditor may or may not like to invite others to gawk at my uneasiness with the topic or to describe me as a racist or a dishonest or unfair person. In my judgment the truth is that his perspective is not clear or is not a long term perspective. Or, perhaps he is just wrong. This is a moral choice. America’s constitution was written by anglo Christians.  Over the years America became legitimately diverse and we are now not an anglo-Christian nation but a Christian nation of free people. We all go by “Americans” and we all pledge allegiance to “one nation under God indivisible with liberty and justice for all”. I seek to secure that liberty for my family and the future children I intend to raise in a goodly manner. I stand firmly on my faith and hope and my love for others that marriage will and should be defined as it has been since before the inception of the country as one man and one woman aiming to improve based upon the lessons learned from the previous generation and lessons inspired by He who used to be referred to as the American spirit.

I would also like to add that I do not presume to speak for God at this time, although, I believe that His wisdom is available to us today to examine and re-examine and learn from. I am grateful for the spoken words of prophets (Amos 3:7).  One of those prophets is Thomas S. Monson.

Ultimately, to allow same-sex marriages could also complicate and confuse genealogical record keeping significantly for children entrusted to the guardianship of such partnerships including records regarding more remote generations (perhaps more than one generation back), and other religious practices regarding genealogy.

Now, onto the legal issues--
1) No Constitutional "fundamental right" to "homosexual marriage" exists or has existed in the history of American jurisprudence.  Thus, liberty interests under the Due Process Clause of the 14th Amendment do not apply to "homosexual marriage".  The Supreme Court has yet to weigh in on this issue.  If it does it should consider it's own words about the family unit in American tradition/history and the dissemination of morals:
“Our decisions establish that the Constitution protects the sanctity of the family precisely because the institution of the family is deeply rooted in the Nation’s history and tradition.  It is through the family that we inculcate and pass down many of our most cherished values, moral and cultural.” Moore v City of East Cleveland, Ohio
   2) The Constitutional level of scrutiny for sexual orientation under the Equal Protection Clause of the 14th Amendment is merely the Rational Basis Test.  Romer v. Evans.  This means, that a state government need merely assert any legitimate government interest rationally related to their state promulgated law.  This standard is very broad and should be easy to meet--the state can simply refer to its police powers -- maintaining health, safety, morals, etc.

July 4th and More

Our fourth went off with bang and turned into a fabulous day.  Julia worked all day on her last paper for American Heritage.  The theme of the paper was significant events and policies in American history which and how they directly impacted her family history.  Naturally, Julia earned an A on the paper...par for the course.

We made a killer salad with red onion, orange bell peppers, tomatoes, carrots, romain lettuce hearts, and  balsamic vinaigrette.  Then we met up with W & K Meservy and J & A Ankenman.  We had a lovely delicious time eating black bean burgers beneath a large tree.  And, we even talked about book clubs, graduate schools, babies, and politics.

In the evening we joined J & J Harding, W & K Meservy, and J & A Ankenman to watch the fireworks go off on a secret hill behind Y View which turned out to be not so secret.  J brought great mango and tropical otter-pops and played Beach Boys on his phone.  Everyone seemed to enjoy (they were the Stadium of Fire performers) except for Julia who says, "They stink and all their songs sound the same."

Thursday we got soaked in the rain while playing Bocce Ball with J & J Harding.  We walked to our closest large park and although I took an early lead Julia was triumphant.  There were plenty of laughs and then the rain came and we ran for it.  It's been a long time since I've been so drenched by a quick downpour like that.  Afterward, we got warmed up and then did some very needed laundry at the Harding home while we watched Star Wars episode I and had hot chocolate and more otter-pops.  We had them over for dinner before Bocce Ball (fancy hot dogs, corn-on-the-cob, and salad).

Friday was quiet.  We watched The Pebble and the Penguin and had a HUGE mango/ice cream snow cone (from Snack Shack USA by Smiths).

Saturday, we woke up went to SEVEN PEAKS!  We did almost all of the cool rides including the Boomerang and Julia, who is normally afraid of water rides, tried some of the scariest ones and LOVED them.  She was wanting more fun all day.  We left around 1PM and went to help W & K move.  We also got to take our niece out for a long walk which was SUPER fun.  She is adorable and then we watched The Secret of NIMH.

Real Reasons Mitt Romney Deserves Good Press

As a Christian I believe character counts and I believe the Savior counts charity as being very important as told in scripture--here are some great things about presidential candidate Mitt Romney for better or for worse...

*Romney donates 14% of his income annually to charity
*He donated his CEO salary for turning around the 2002 Olympics to charity
*He donated his inheritance to charity
*He served for more than 10 years as a layman for The Church of Jesus Christ of Latter-day Saints (no pay)
*He served as a missionary for The Church of Jesus Christ of Latter-day Saints for two years on his or his father's own dime (no pay)
*He served as a governor for four years (no pay)
*He shut down his business and flew his volunteer employees out to search and rescue his partner's daughter in NYC after she attended a rave and ended up missing--she was found after a call in to the rescue effort asking about a reward led the police to her location
*He gave his pocket cash, $50, to a woman in need on the campaign trail and called over his campaign chairs to help her out during the middle of campaigning
*He calls his rivals (both of whom have attacked his personal integrity) by kind terms. Gingrich + wife he calls each "a friend" and Santorum he calls "a good guy"
*Despite having earned enough money to last a lifetime no matter how many Cadillacs he needs he is determined to serve and turn around the economy for other Americans
*He promotes belief in the United States of America as the greatest nation in the world
*He has been married faithfully to the same woman for more than 42 years and helped her raise a family of sons (all married and educated)

JUXTAPOSING MITT ROMNEY & NEWT GINGRICH

1. EDUCATION

Newt Gingrich has a MA (Master's) and a PhD (Doctorate) in modern European history from Tulane University (LA). His dissertation was entitled "Belgian Education Policy in the Congo: 1945–1960".

Mitt Romney has a JD (Doctor of Law) and an MBA (Masters in Business) from Harvard University. He earned both degrees simultaneously and graduated in the top 5% of his class. He was also valedictorian of BYU after first gaining entrance to Stanford University.

OPINION: The guy with the better grades and education based in law and business will be more helpful to America than the guy with degrees in European history and a focus on Belgium's influence in the Congo.

2. MAJOR LEADERSHIP EXPERIENCE

Newt Gingrich was made the US Speaker of the House of Representatives from 1995-1999. Prior to that he spent six years as the House Minority Whip. In 1997 several House Republicans attempted to remove him as Speaker claiming his public image was a liability--their plan was give him an ultimatum to resign or be voted out. In 1998 he faced another rebellion in the house and agreed to step down from both the position of Speaker as well as a member of the House. He had made the following comment only 1 day after being reelected "I'm willing to lead but I'm not willing to preside over people who are cannibals. My only fear would be that if I tried to stay, it would just overshadow whoever my successor is." He left office in 1999, about two years after he had been charged with ethics charges on 84 accounts. That event, 15 years ago yesterday, was a first for any Speaker of the House in the history of America. Approximately 88% of House Republicans asked that the Speaker be reprimanded for his ethics.

Newt Gingrich ended two marriages in divorce with infidelity widely accepted as the reason for their end. He was to blame. One of his daughters from his first marriage (he has two, both from the first marriage) has joined his campaign.

Newt Gingrich's 2012 presidential campaign hit a large snag on June 9 and June 21, 2011 when he went on an unplanned vacation and several key members of his staff including his longtime spokesman and his campaign manager quit citing internal disagreements about the direction of the campaign. This occurred while he was on vacation.

Senate Majority Leader Harry Reid publicly announced in January 2012 that if Gingrich became the president of the USA he would promise to make it his personal mission to make sure Gingrich is a one term president.

President Ronald Reagan mentioned Newt Gingrich once in his diaries. It was in response to a bad idea that Newt had given him.

Mitt Romney was the Republican Governor of Massachusetts from 2003-2007. While in office his major credentials include having balanced the budget and putting in place a $2 billion rainy day fund, signing in Massachusetts heath care reform, expanding scholarships for college students in the #1 ranked education system in the USA, and overseeing a series of spending cuts and fee increases. He took no salary as governor.

Mitt Romney is the father of 5 sons who have all attended prestigious universities and married. He has been married to the same woman, Ann Romney, for 42 years. Four of his sons have joined him on the campaign trail--the fifth has expressed a desire to be there but a duty to finish his medical school residency.

Mitt Romney was the CEO of the 2002 Olympics. He joined the effort while they were scandal ridden and projected to lose money. Instead, they became one of the most financially successful winter olympics in history as well as one of the most watched.

Mitt Romney was hired by Bain & Company, a management consulting firm, in 1977. The head of Bain & Company offered Romney a partnership deal in a spinoff company, a private equity investment firm, called Bain Capitol in 1984. Romney was extremely careful in his decisions on investments. His first major success was in 1986 with Staples Inc. They soon moved from start ups to leveraged buyouts. Some of the companies they helped turn around include Dominos Pizza, Sports Authority, Artisan Entertainment, Brookstone, and others. During the 14 years Romney headed the company Bain Capital's average annual internal rate of return on realized investments was 113%. Romney's work was heavily data driven and averse to risk. And, in 1990, Romney was asked to return to his original employer, Bain & Company, which was facing financial collapse. He became its CEO in January 1991 but took no effective salary. Within one year he had turned Bain & Company and its 5,000 employees around, given it back to new leadership, and returned to Bain Capital.

Mitt Romney served as a local lay clergy in The Church of Jesus Christ of Latter-day Saints. He was a Bishop from 1981-1986. And from 1986-1994 he presided over the Boston Stake with its approximately 4,000 church members.

Mitt Romney despite losing the race for the presidency in 2008 emerged in 2012 with a very powerful campaign structure. He has consistently earned more donations than any of his fellow Republican opponents and has garnered far more endorsements. These endorsements include prominent leaders and politicians including--
*Governor Chris Christie (New Jersey)
*Governor Nikki Haley (South Carolina)
*Governor Bob McDonnell (Virginia)
*Governor Tim Pawlenty (Minnesota, 2003-2011)
*Governor Jon Huntsman Jr (Utah, 2005-2009)
*Governor Robert Ray (Iowa, 1969-1983)
*Governor John Sununu (New Hampshire, 1983-1989)
*Governor Frank Keating (Oklahoma, 1995-2003)
*V President Dan Quayle (1989-1993)
*Senate Majority Leader Bob Dole (-1996)
*Senator John McCain
*Senator Scott Brown
*Senator Kelly Ayotte
*Senator John Thune
*Senator John Hoeven
*Senator Lisa Murkowski
*Senator Mark Kirk
*Senator Orrin Hatch
*Representative Ros-Lehtinen (Florida)
*Representative Diaz-Balart (Florida)
*Representative Womack (Arkansas)
*Representative McCotter (Michigan)
*UN Ambassador Bolton (2005-2006)
AND, President George H W Bush has indicated Romney is the "best"

3. MORALS

Mitt Romney has had 1 wife, 1 religion, and has released his jobs plan, a book explaining his positions, and answered countless questions in interviews.

Newt Gingrich has had 3 wives, 3 religions, has released no jobs plan--no number of projected jobs, has released no book explaining his positions, and has dodged questions about his former marriage in a recent CNN debate. He has also made countless incendiary statements which have garnered him considerable political hype akin to a Lady Gaga or a Katy Perry. Among his stunts he has posted his taxes for one year on the internet during a debate and attacked Mitt Romney for not doing likewise DURING the debate. This is after he called for no attack ads and reversed his own position. He similarly did attack Mitt Romney's campaign claiming that until they release the taxes he would not trust them on anything. Thus, he took direct aim at Romney's character amidst Romney asserting that he had been "honest in his dealings".

Addendum--
On Tuesday Jan 24, 2012 Mitt Romney released his tax returns for 2010 and 2011. This is more than any other candidate. It is widely regarded by tax professionals cited by Forbes, CNN, etc that his finances were legally maintained and taxed properly and that he gave a considerable amount to various charity (roughly $6 million). He also paid a full 10% to The Church of Jesus Christ of Latter-day Saints in tithes.

Newt Gingrich may be in trouble for his own taxes according to Forbes' Janet Novack's report. “Newt Gingrich avoided tens of thousands of dollars in Medicare payroll taxes in 2010 by using a technique the Internal Revenue Service has consistently and successfully attacked.” This technique has been dubbed the "John Edwards Loophole".
